REASONS FOR ORDER AND ORDER
[1] The Court is dealing with a motion submitted by Telus Communications Inc. (the respondent) seeking a stay of proceedings during the proceedings before the Federal Court of Appeal in docket A-69-10.
[2] This motion is intimately linked with a similar motion that was submitted at the same time by the respondent in docket T-2087-09 and that the undersigned judge dismissed in a direction issued at the same time as this order.
[3] At the first paragraph of its notice of motion seeking the stay of these proceedings, the respondent notes that a stay order for this docket is required [translation] “only if the motion for a stay of proceedings is allowed in Federal Court docket No. T-2087-09.”
[4] Under these circumstances, the motion for a stay of proceedings in this docket will be dismissed. As in the decision regarding the motion to stay the proceedings in docket T-2087-09, this order will in no way prevent the respondent from submitting a motion to stay the proceedings at a later time.
ORDER
THE COURT ORDERS that the motion is dismissed without costs.
