[1] This is an assessment of the Defendant’s bill of costs following the Court’s granting of the Defendant’s notice of motion for an order striking out the Statement of Claim in its entirety with costs to the Defendant.
[2] The Defendant filed the bill of costs and an affidavit on April 3, 2007 and requested the assessment be conducted in writing.
[3] The Plaintiff filed written representations in response to the bill of costs on April 4, 2007. On the basis of the documents on file, the assessment proceeded.
[4] The Defendant’s fees are allowed at $720 for the following items per Tariff B : Item 5 (Preparation, service and filing of Motion) 3 units; Item 6 (Appearance on a motion) 1 unit; Item 26 (Assessment of Costs) 2 units.
[5] The Defendant submitted $854.15 in disbursements for photocopying costs. Given the volume of material which had to be reproduced and the amount sought is supported by invoices, the requested amount is allowed.
[6] The bill of costs totalling $1,574.15 is allowed. A certificate of assessment in this amount will be issued.
