ASSESSMENT OF COSTS – REASONS
MICHELLE LAMY, ASSESSMENT OFFICER
[1] This is an assessment of the defendant’s costs following the judgment of October 3, 2005 dismissing the action at bar and the order of December 19, 2005 dismissing a motion by the plaintiff for an extension of time. At the defendant’s request, I issued a schedule directing the parties to make their written submissions. As I have received no reply, I am prepared to proceed with the assessment of the bills as submitted.
[2] Apart from item 26, the fees are awarded as requested in the amount of $1,986 for items 5 (14 units), 6 (3 units x 11 min.) and 26 (2 units) of Tariff B. As the plaintiff has made no submissions, I must assume that the compensation sought is reasonable in the circumstances. As the bills were assessed simultaneously, I award 2 units under item 26.
[3] All the disbursements incurred in this case, evidence of which was provided by affidavit, are allowed in the amount of $128.11.
[4] In conclusion, the defendant’s costs are assessed and allowed in the sum of $2,114.11. A certificate is issued for that amount.
