Date: 20020322
Docket: IMM-1005-02
Neutral citation: 2002 FCT 328
BETWEEN:
KODJO AFANDONOUGBO
Applicant
and
THE MINISTER OF CITIZENSHIP AND IMMIGRATION
Respondent
[1] The purpose of the stay sought by the applicant is to prevent the conditional deportation order made against him on August 3, 2000, which became enforceable on February 19, 2002, from becoming a deemed deportation order on March 25, 2002.
[2] Like Rothstein J. (as he then was) in Rajan v. MCI (1994), 86 F.T.R. 70, I am of the view that this Court is without jurisdiction to grant a stay to the applicant.
[3] Consequently, the applicant's motion is hereby dismissed.
