[1] In an order dated August 30, 1999, the Honourable Mr. Justice Max M. Teitelbaum granted the application for judicial review in the instant matter.
[2] According to that order, a specific schedule was established and the hearing of the application for judicial review was set for Wednesday, November 24, 1999 at Québec.
[3] It appears from a letter received from Mr. Howard R. Eddy, legal advisor for the Immigration and Refugee Board, that the Board will not be able to provide the Registry and each of the parties with copies of the file by September 20, 1999.
[4] It is a very voluminous file which includes a transcript of more than 12,000 pages and the Board is seeking a further two-week extension to provide the files to the parties.
[5] The request seems justified in light of the circumstances, and the Honourable Mr. Justice Max M. Teitelbaum"s order will accordingly be modified to give the Immigration and Refugee Board the necessary time to prepare the files.
[6] According to two letters on file dated September 8 and 9, 1999, counsel for both parties agree to the extension of the period for providing the file.
[7] Accordingly, THIS COURT HEREBY ORDERS that:
1. The hearing of the application for judicial review, which is scheduled to last one and a half days, is set for Tuesday, January 11 and Wednesday, January 12, 2000 at 9:30 a.m. at Québec, Quebec; |
2. The administrative tribunal shall provide each of the parties and the Registry with certified copies of its file on or before October 4, 1999; |
3. The applicants shall serve and file any other affidavits on or before October 14, 1999; |
4. The respondent shall serve and file any other affidavits on or before October 21, 1999; |
5. The cross-examinations on the affidavits, if any, shall be completed on or before November 1, 1999; |
6. The applicants shall serve and file their memorandum, if any, on or before November 12, 1999; |
7. The respondent shall serve and file her memorandum, if any, on or before November 22, 1999; |
8. The transcripts of the cross-examinations on the affidavits, if any, shall be filed on or before November 29, 1999. |
