Date: 20001219
Docket: IMM-665-00
MONTRÉAL, QUEBEC, DECEMBER 19, 2000
BEFORE: NADON J.
BETWEEN:
KAPINGA MARIE-CLAIRE NTAMBWE
Plaintiff
AND:
THE MINISTER OF CITIZENSHIP AND IMMIGRATION
Defendant
ORDER AND REASONS FOR ORDER
NADON J.
[1] The Refugee Division concluded that the plaintiff was not credible and dismissed her application for refugee status.
[2] In support of its conclusion, the Refugee Division gave six reasons. These reasons clearly explain why the Refugee Division did not believe most of the plaintiff's account.
[3] The plaintiff did not persuade the Court that its intervention would be justified. Even if some of the reasons given by the Refugee Division may be open to criticism in some respects, that does not suffice for a conclusion that there was an error justifying intervention. In my opinion, the finding of a lack of credibility is not in any way unreasonable.
[4] For these reasons, the application for judicial review is dismissed.
