[1] This is the taxation of costs awarded to the plaintiff by Tremblay-Lamer J. on a motion by the interveners, Southam Inc. and Thomson Canada Ltd.
[2] As the trial judge's judgment has been appealed Mark Bantey, counsel for the intervener, argued at the start of the taxation that the latter was premature. After a discussion, the parties agreed in writing that the taxation would proceed notwithstanding the appeal.
[3] In view of the submissions made at the time of taxation, the plaintiff's costs resulting from the interveners' motion are allowed as follows:
. 5 units under item 5 for the record prepared and filed pursuant to Rule 365 of the Federal Court Rules, namely $500; |
. 2 units under item 6 for the appearance of counsel for the plaintiff on February 28, 2000, namely $33.34 ($200 x 10 minutes, that is, hearing time); |
. 3 units under item 26 for assessment of costs. |
[4] The disbursements incurred by the plaintiff in the amount of $70.50 are allowed as claimed.
[5] The instant bill of costs is accordingly taxed in the amount of $903.84. A certificate is issued for this amount.
