This action was dismissed with costs on August 31, 1999. The Defendant's' bill of costs was filed by Mr. Dominique Guimond on August 23, 2002 with the request to be assessed without the personal appearance of parties.
[2] Mr. Nagi Ebrahim, the Plaintiff's solicitor, was given until October 4, 2002 to serve and file written representations in response to the bill of costs. To date none have been received. The assessment will proceed on the basis of the documentation on file.
[3] Counsel for the Defendant is asking for the maximum number of units for the various applicable items of Tariff B. In the absence of representations from the Plaintiff these items are allowed as submitted with the exception of item 26 which will be reduced from 6 to 3 units.
[4] The disbursements in the amount of $67.55 are supported by evidence and will be allowed.
[5] The Defendant's bill of costs is assessed and allowed in the amount of $5,573.05. A certificate of assessment will issue in that amount.
