Date: 19990430
Docket: IMM-1890-98
BETWEEN:
BALWANT SINGH TAGGER
Applicant
- and -
THE MINISTER OF CITIZENSHIP AND IMMIGRATION
Respondent
REASONS FOR ORDER
TREMBLAY-LAMER J.:
[1] This is an application for judicial review of a decision of the CRDD, wherein the Applicant was determined not to be a refugee according to the Convention.
[2] Although the Applicant was advised that his counsel would be unable to argue his application for judicial review for medical reasons, he failed to give any indication whether he wished to pursue his file with another counsel. In light of his lack of interest, this application for judicial review is dismissed on the existing record.
[3] The Refugee Division found the Applicant not to be credible. Having reviewed the many inconsistencies and implausibilities identified by the Board, I believe that the findings were open to it on the evidence.
[4] The application for judicial review is dismissed.
