ASSESSMENT OF COSTS - REASONS
MICHELLE LAMY, ASSESSMENT OFFICER
[1] Pursuant to the discontinuance filed by the appellant, this is an assessment of the respondent's costs under rule 402 of the Federal Court Rules, 1998.
[2] On August 6, 2001, we sent the appellant's counsel, by registered mail, a copy of the bill of costs that was amended by the respondent on July 31 and instructed him to submit his written representations by August 27, 2001.
[3] Since we have not received any written representations to this day, we allow the respondent's costs as requested with the exception of item 26. We allow 2 units for this item because the assessment is not contested.
[4] The respondent's costs are assessed in the amount of $1,596.14, which represents $1,138.75 for costs ($990.00 + taxes) and $457.39 for disbursements. A certificate will issue in the amount of $1,596.14.
