This is an application for judicial review of a decision of the Refugee Division (the tribunal) dated December 28, 1995, determining the respondent to be a refugee. Pursuant to the recent decisions of this Court in Pinnock (November 6, 1996), IMM-3139-95 and Whittingham (January 30, 1997), IMM-2572-95, counsel for the respondent acknowledges that the application for judicial review must be allowed and the decision must be set aside.
For these reasons, the matter is referred back to be reheard by a differently constituted tribunal.
