ASSESSMENT OF COSTS - REASONS
DIANE PERRIER - ASSESSMENT OFFICER
[1] On April 8, 2004, the Honourable Mr. Justice Martineau dismissed the application for judicial review with costs against the applicant.
[2] Sébastien Gagné filed his bill of costs on January 20, 2005, and asked that it be assessed without the appearance of the parties. On March 7, 2005, we sent letters to the parties setting a schedule for the filing of their written submissions. No submissions have been filed to date, so I am prepared to assess the costs based on the documentation on file.
[3] The fees requested are allowed with the exception of items 7 and 26. Item 7 is not allowed since this item serves to compensate the services rendered under Rules 222 et seq. of the Federal Court Rules for discovery of documents in the context of an action. Item 26 is reduced to two units given that this assessment is uncontested.
[4] The disbursements claimed in the amount of $1,163.24 and established by the affidavit of Sébastien Gagné and the accompanying exhibits are reasonable in my opinion and are awarded as requested.
[5] The respondents' bill of costs is assessed in the amount of $3,253.24. A certificate will be issued for that amount.
