TEITELBAUM J.

[1]      Counsel for the applicant informed Counsel for the respondent that she wishes to raise an issue not previously raised in the applicant's memorandum of argument.

[2]      Counsel for the respondent objected saying that the day of the hearing is not the time to raise a new argument nor is he ready to make argument on the new submissions.

[3]      Counsel for the applicant informed the Court that the new issue is of the utmost importance if she is to do justice to her client's case.

[4]      I adjourned, in the interest of justice, the hearing.

[5]      The applicant is to file and serve an amended memorandum of argument within 30 days of today's date.

[6]      The respondent shall have 30 days of being served with the applicant's amended memorandum to serve and file, if the respondent wishes to do so, an amended memorandum of argument.

[7]      In that this matter arose at the time of the hearing, I award costs in the sum of $500 to the respondent. This sum of $500 for costs must be paid within a delay of 30 days of today's date, failing which the present application for judicial review will be dismissed.

[8]      The office of the Associate Chief Justice will set a new hearing date no sooner than 60 days of today's date.
