CITIZENSHIP ACT
Respondent
BEFORE: THE HONOURABLE MR. JUSTICE WETSTON
HELD AT: The Federal Court, 330 University Avenue, Toronto, Ontario. |
DATE: October 8th, 1997.
REGISTRAR: R. CLAPHAM
REASONS FOR DECISION
A P P E A R A N C E S:
MS. K. GRONOFSKY The Applicant
P. LARGE, ESQ. Amicus Curiae
HIS LORDSHIP: On the matter before me is the appeal of Chung Chuen Wong and the grounds for appeal is primarily based upon knowledge of Canada under Section 5(1)(e) of the Citizenship Act. The matter before me is trial de novo or hearing de novo and obviously Mr. Wong in not satisfying the Citizenship Judge has made an effort to attempt to satisfy this Court that he has sufficient knowledge of Canada.
There is a lot to know, Mr. Wong, and I did note that while the questions from your counsel were obviously questions that you worked on together, which I think is obviously appropriate in these kinds of matters, I did note that the questions from Mr. Large, the Amicus Curiae were of course not worked on together and as such I paid particular attention to the answers to those questions, with all due respect to your counsel.
It seems to me that you have obviously met all the other requirements since your application for citizenship was turned down on the basis of Section 5(1)(e), and I am satisfied that you have now made sufficient effort to at least obtain sufficient knowledge of Canada to meet that requirement. In this case I therefore will allow your appeal.
CERTIFIED CORRECT,
