REASONS FOR ORDER
PINARD J.
[1] The plaintiffs' preliminary objection regarding the defendants' delay in filing this motion, in light of the order by McGillis J. dated April 29, 2002, is dismissed. The examination for discovery of Jacques Tanguay was held on October 15, 2001, that is before the deadline of June 7, 2002, set in the order by McGillis J. for proceeding with the examinations for discovery. As this is a motion regarding objections and undertakings in Mr. Tanguay's examination for discovery, I do not consider that the motion at bar contravenes the order by McGillis J.
[2] The Court has taken note of the discontinuance of the application made by the defendants in respect of undertakings Nos. 1 and 5 mentioned in this motion.
[3] On the remainder, the motion is allowed in part only. The information contained in the letter of March 28, 2002, sent by counsel for the plaintiffs to counsel for the defendants, regarding the other undertakings Nos. 2, 3, 9 and 10, seems to the Court to be admissible and reasonably sufficient, subject to:
A. the plaintiffs' obligation to make the witness Jacques Tanguay available to the defendants for continuation of his examination on this information by Friday, October 18, 2002, at the latest;
B. the determination by the trial judge of any point relating to the relevance and evidentiary force of this information; and
C. the defendants' obligation to protect the confidentiality of the information provided in respect of undertakings Nos. 9 and 10.
[4] The whole with costs to follow.
