Date: 20000601
Docket: IMM-3856-98
BETWEEN:
RAJESH DAHYABHAI PATEL
Applicant
-and-
THE MINISTER OF CITIZENSHIP
AND IMMIGRATION
Respondent
REASONS FOR ORDER AND ORDER
CAMPBELL J.
[1] In the present case, the Applicant applied for permanent residence as a "Commercial Photographer" based on part time experience between September 1989 and March 1998. It is agreed that the experience required to be successful in the application is one year, calculated on a cumulative basis. That is, part time experience over a number of years can meet the standard required.
[2] I am satisfied that, in rejecting the application, the Visa Officer concerned did not properly consider all the evidence supplied by the Applicant on the experience factor. Therefore, I find that the Visa Officer"s decision was made in reviewable error.
ORDER
[3] Accordingly, I set the Visa Officer"s decision aside and refer this matter to another Visa Officer for re-determination.
