[1] This is a motion seeking to appeal the decision of the Prothonotary Lafrenière dated August 18th, 2000 dismissing the motion of Istvan Szebenyi Jr. for leave to represent his mother. I have carefully reviewed the material filed.
[2] In my opinion, the decision of Mr. Justice Gibson to deny the Plaintiff to represent his mother was not appealed.
[3] Upon being satisfied that the relief sought by the Applicant is "res judicata";
[4] For these reasons, this motion to appeal the decision of the Prothonotary Lafrenière dated August 18th, 2000 is dismissed.
