Date: 20000817
Docket: IMM-2369-00
CALGARY, Alberta, Thursday, the 17th day of August, 2000.
PRESENT: THE HONOURABLE MR. JUSTICE TEITELBAUM
BETWEEN:
SADAT HUMAYUN CHOUDHARY
Applicant
- and -
THE MINISTER OF CITIZENSHIP
AND IMMIGRATION
Respondent
ORDER AND REASONS FOR ORDER
TEITELBAUM, J.:
[1] The application for an extension of time for service and filing a record on behalf of the Applicant is denied.
[2] In order to obtain an extension of time in order to perfect an application for Leave and for Judicial Review the Applicant must show that an arguable case exists and that there were serious reasons as to why the application could not have been perfected withn the legal delays.
[3] I have no evidence before me that would convince me that the Applicant has an arguable case.
[4] The evidence before me as to why the Application Record could not have been completed in the legal delays is insufficient. The fact that the Applicant"s wife was expecting a baby and the Applicant was busy at work is not a sufficient reason for not perfecting the Application for Leave.
[5] The present application is denied. |
