[1] On March 7, 2000, the Court allowed the plaintiff's motion for consent judgment and ordered the defendant to pay the amount of $98,009.22 plus interests and costs.
[2] Following the filing of the plaintiff's bill of costs, the assessment proceeded on August 16, 2000, by conference call in the presence of Mrs. Mélanie Bernier, counsel for the plaintiff. The defendant is not represented in this instance.
[3] Although solicitors, Greenberg & Levine, have been served with the bill of costs, Mr. Harry Greenberg informed me on August 15 that he will not be present at the taxation.
[4] In light of the above and the evidence filed in support of the bill of costs, the plaintiff's fees are allowed as follows: items 1 (7 units), 4 (4 units), 25 (1 unit) and 26 (2 units). It should be noted that two (2) units are allowed under item 26 as that proceeding was not disputed.
[5] The disbursements in the amount of $189.90 are assessed as claimed, as well as the amount of $150.00 paid under Tariff A for the filing of the Statement of Claim. The claim made under Tariff A for the issuance of a writ of execution is refused. No writ has been issued in this instance so far.
[6] The plaintiff's bill of costs is taxed and allowed in the amount of $1,739.90 .
