[1] The application for judicial review filed in the case at bar was dismissed with costs on October 1, 2003. Éric Lafrenière, the respondent's counsel, filed his bill of costs on September 8, 2004 and asked that it be assessed without a personal appearance by the parties. The Correctional Service of Canada had not been given the status of an intervener in the proceeding.
[2] A schedule for the filing of submissions was drawn up and given to the parties on September 22, 2004. To date, no submissions have been filed. In view of the foregoing, I am prepared to assess the costs in the respondent's favour.
[3] The fees claimed and the disbursements for photocopying and for bailiff's fees are awarded as submitted.
[4] The respondent's costs are assessed and allowed in the amount of $1,585.46.
