[1] On August 21, 2001 Pierre Lamothe, representing the defendant, filed a bill of costs pursuant to the order made by Nadon J. on December 11, 2000 dismissing the motion with costs.
[2] In a service request accompanying his bill Mr. Lamothe asked that the case proceed in writing for assessment of the costs. On September 20, 2001 letters were sent to the parties asking them to file and serve their written submissions. As no submissions have been received within the specified deadlines, the bill is assessed.
[3] The claims under items 5 and 25 are allowed as requested. The claim under item 26 is reduced to 2 units since the assessment of costs was not challenged. The request for disbursements of $82.34 for service of the reply record is awarded.
[4] The defendant's costs are assessed and allowed in the amount of $880 for fees and $82.34 for disbursements. A certificate is issued in the amount of $962.34.
