Neutral citation: 2002 FCT 571
CALGARY, Alberta, Wednesday, the 15th day of May, 2002.
Present: THE HONOURABLE MR. JUSTICE CAMPBELL
BETWEEN:
NGUYET HUYNH
Applicant
- and -
THE MINISTER OF CITIZENSHIP & IMMIGRATION
Respondent
REASONS FOR ORDER AND ORDER
CAMPBELL, J.:
[1] I am satisfied on the record that all the evidence was not considered in reaching a proper
decision on Mr. Huynh's application to be included as a defendant son on the applicant mother's application for landing. I thus find that the decision was reached in reviewable error.
ORDER
[2] Accordingly, the decision of July 19, 2000 is set aside and the matter is referred to another visa officer for determination, on a direction that the redetermination be carried out on the evidence produced by Mr. Huynh and his mother up to July 31, 2000.
