[1] The applicant had been ordered to pay the amount of $1,500.00 in Court as security for costs by August 15, 2003. On August 13, 2003 Dr. Ayangma filed a discontinuance. Ms. Jessica Harris, counsel for the respondent, filed her bill of costs and requested that it be assessed in writing pursuant to Rule 402. The applicant did not file written representations in opposition to the bill of costs.
[2] Counsel requests the minimum level of units for items 5 and 26 of column 3. These will therefore be allowed as presented. The disbursements for photocopying and courier charges are also allowed, being supported by affidavit evidence.
[3] The bill of costs of the respondent is assessed and allowed in the amounts of $550.00 for fees and $224.79 for disbursements. A certificate of assessment will issue in the amount of $774.79.
