GILES, A.S.P.:
A non-party with an interest in the outcome of a case as such has no right to attend discoveries or be informed of any information which is disclosed or to see any of the documents produced, but a party may inform any person of anything found out by discovery if it is for the purposes of this action but not, for instance, for the purposes of avoiding a damage action by a licensee which might arise if this action were to be lost. If a party or its counsel in fact informs anyone for the purposes of this action, the party and its counsel are responsible to the Court for insuring that the person informed does not use the information for any collateral purpose. The requested order asks that I prohibit giving information to non-parties. That I can not do because it would prohibit a party informing a non-party for the purposes of this action. The motion will therefore be dismissed.
ORDER
Motion dismissed, one half the costs of this motion in the cause.
