Docket: IMM-4431-00
Neutral citation: 2001 FCT 1273
BETWEEN:
HSIANG HUI LIAO
Applicant
and
THE MINISTER OF CITIZENSHIP
AND IMMIGRATION
Respondent
[1] The Applicant seeks an order quashing the decision of a Visa Officer dated July 17, 2000, rejecting her application for permanent residence in Canada.
[2] The Applicant argues, and the Respondent admits, that a reviewable error occurred in the Visa Officer's administration of the language proficiency assessment in that the Visa Officer did not conduct a full reading assessment. I see no reason not to exercise my discretion to act upon this error.
O R D E R
[3] Accordingly, I set aside the Visa Officer's decision and refer this matter to a different visa officer for redetermination.
