[1] On November 8, 2002, Pinard J. dismissed the application for judicial review with costs.
[2] On May 7, 2003, Sébastien Gagné, counsel for the defendants, filed a bill of costs and asked that it be assessed without a personal appearance by the parties. On June 10, 2003, we sent letters to the parties setting a schedule for the filing of their written submissions. As no written submission has been filed to date, I am prepared to assess the costs based on the documentation in the record.
[3] The fees requested are allowed, except for items 26 and 27. Item 26 is reduced to 2 units as there was no opposition. Item 27 cannot be allowed, since no sum is provided for the appearance in Tariff B.
[4] Disbursements in the amount of $1,354.06 are awarded, since they are regarded as reasonable and were proven by Lyne Lasalle's affidavit.
[5] The bill of costs is accordingly assessed and allowed in the amount of $2,949.06. An assessment certificate will be issued for that amount.
