TAXATION OF COSTS - REASONS
RICHARD LARABIE, ASSESSMENT OFFICER
[1] On August 30, 2002, a bill of costs was filed in this action pursuant to the Order of Mr. Justice W. P. McKeown awarding costs to the Plaintiff.
[2] In a letter accompanying his bill of costs, Mr. Dominique Guimond, representing the Plaintiff, requested that the taxation be dealt with in writing. Letters were therefore sent to the parties inviting them to file their representations in writing. No representations were filed within the allotted times.
[3] Mr. Guimond requests 6 units under item 1, 3 units under item 4, and 3 units under item 26. I will allow the 6 units claimed under item 1 however, since no appearance was ever filed the 3 units claimed under item 4 will be reduced to 2 units and the 3 units claimed under item 26 will also be reduced to 2 units. The amount of $166.37 claimed as disbursements will be allowed.
[4] The bill of costs of Plaintiff is assessed and allowed at $1,100.00 for assessable services and $166.37 for disbursements. A certificate of taxation will be issued in the amount of $1,266.37.
