[1] I am satisfied that the tripartite test has been met. |
[2] The Applicants' application for judicial review raises a serious issue, i.e. whether the Information Commissioner can resort to subsections 30(3) and 36 after having completed his investigation concerning various complaints made by the complainant regarding the unreasonableness of the time extensions. |
[3] I agree with the Attorney General that irreparable harm will result if the relief sought is not allowed. |
[4] Finally, the balance of convenience, in all of the circumstances, favours the Attorney General. The Attorney General shall have her costs on this motion. |
